What Does Business Law Typically Entail?
Business law is what happens when someone wants to start a new business, such as setting up an LLC. They may need help while they’re running it, perhaps with debt collection, entering into a new contract or ending the business, whether because there are problems with the partners or it’s just not going well.
What Are The Common Types Of Business Law Cases That You Handle?
We represent problems with owners or partners not getting along for reasons stemming from growing pains of the company to the opposite. Often the perceptions of one owner turn out to be different from the others; sometimes one gets greedy or involved in a divorce or has credit difficulty and starts making very poor decisions. The other set of problems come in dealing with lenders and creditors, especially when things are not going well in a company, which is where I can help with those issues. We also represent several companies that deal with real estate transactions, so we’re involved in drafting and reviewing real estate contracts, checking for clean title on properties, and even working with cities and counties for zoning approvals.
Sometimes we represent expanding business owners to help set up new companies: we get them the federal ID numbers and the necessary filings with the state. We have considerable experience with reviewing funding propositions to minimize getting scammed; we also draft building and farm leases. Of course, many businesses fail, and we’ve aided the resolution of many dissolution’s, both in and out of court.
How Are Most Business Conflicts Or Disputes Resolved?
Depending on the animosity and whether it’s a creditor or a partner, it’s my goal to try to get these conflicts resolved without having to go to court. Sometimes it can’t be avoided, but the vast majority of cases, we’re able to resolve short of court.
Who Do You Typically Take On As Clients?
We represent some clients with high net worth, and we’re often involved in real estate subdivision development, which requires a great deal of capital. But the bread and butter clients for business are small businesses, with the questions and issues all small businesses deal with every day, from the beginning to the end and everything in between. It can be as broad as a company wanting to buy a new property or obtaining an agreement between the partners to buy insurance, as well as dealing with creditors, lenders or just helping them set up loans. That’s the bread and butter for us.
